The present petition has been filed by the petitioners under Article 226 of the Constitution of India, with the following prayers :- “10.1 This Hon'ble Court be pleased to summon the entire record pertaining to the case of the petitioner by issuing a writ certiorari for kind perusal, 10.2 And after perusal of record be pleased to direct the concerned respondents to release the entire balance amount 9.03,403/- Lakh in favour of the ₹ petitioner with interest at bank rate, 10.3 Be pleased to order the respondent/ EE to recover 1.53 lakh with interest at bank rate from private respondents or in case the payment to the private respondent is not made, the above said amount be deducted from his account and be paid to the petitioner, by issuing a writ of mandamus in the ends of justice. 10.4 Cost of the petition be awarded to the petitioner against the respondents. 10.5 Any appropriate writ, direction or order may also kindly be passed which this Hon'ble Court deems fit and appropriate in the circumstances of the case in the interest of justice.” 3. The learned State counsel has produced a copy of the letter dated 14.07.2026 addressed to the Collector by the Executive Engineer, Public Works Department, Mungeli Division, informing that the concerned authority has requisitioned the cheque for the balance amount payable to the petitioner and that, upon receipt of the said cheque, the same shall be handed over to the petitioner. 4. In view of the statement made by the learned State counsel and the letter dated 14.07.2026 produced before this Court indicating that the process for disbursement of the balance amount payable 3 to the petitioner has already been initiated and that the amount shall be handed over to the petitioner upon receipt of the cheque, learned counsel for the petitioner seeks permission to withdraw the present petition. 5.
