Mr. Madhu Jana Ms. Puja Sonkar …for the State Affidavit of service filed by the petitioners is taken on record. The private respondents and the Panchayat are not represented despite service. The petitioners are the members of Silampur – II Gram Panchayat and submitted a no confidence motion for removal of the Upa Pradhan of the Panchayat before the Prescribed Authority on May 15, 2026 which was received by the latter on May 16, 2026. No step has been taken by the Prescribed Authority pursuant to the same. It is most unfortunate that the Prescribed Authority is oblivious of the time frame laid down under Section 12 of the West Bengal Panchayat Act, 1973. In view of the fact that the said time frame has already expired, the Prescribed Authority and the Block Development Officer Kaliachak-I Development Block, being the 3rd respondent herein, is directed to treat the date of communication of this order as the date of submission of the motion before him and take the proceeding to its logical conclusion in terms of Section 12 of the Act of 1973, particularly the time frame stipulated therein. The Inspector in Charge, Kaliachak Police Station, being the 6th respondent herein, is directed to render necessary assistance to the 3rd respondent so that the meeting is held peacefully and without any disturbance from any corner whatsoever. The writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
