Agrawal Judgment on Board 17.07.2026 1. The petitioners have filed this petition for grant of regular pay-scale of Rs. 2550-3200 w.e.f. 05.09.2008 i.e. from the date when similarly situated employees have been granted the said pay-scale. 2. State has filed an affidavit in compliance of order dated 13.09.2023 in which paragraphs 2 & 3 state as under : “2. That, in compliance of the Hon'ble Courts order the case of all the petitioners was considered as against the employee namely Kanak Ram Khandekar and on examination of the cases, it has been found that the petitioner no. 1 to 5 have been given the benefit of the pay scale 2550-55-2660-3200 from 01-01-96 whereas petitioner no. 6 has died, the petitioner no. 7 to 10 have been granted the benefit of the said pay scale 2550-55-2660-3200 from 01-01-96 and the petitioner no.7 has retired also further petitioner no. 11 is posted at GPM District and petitioner no. 12 to 14 have been given the benefit of the pay scale on 01-01- 96 and petitioner no. 15 and 16 cannot be given the benefit of pay scale of 2550-55-2660-3200 from the date as claimed by them in the petition as their appointment was made on compassionate basis in the year 2014, the petitioner no. 15 namely Dinesh Kumar Yadav was appointed on 08-07-2014 and the petitioner no. 16 was appointed on 18-07-2014 which is evident from the annexed chart reflecting the grant of pay scale to the petitioners which is annexed herewith as ANNEXURE-D/1 (colly). 5 3. Therefore, it can be stated that the petitioners have already been granted the benefit or the pay scale much before the date as claimed by them under relief clause 10.2 i.e. 01-01-96 and their claim for parity with the employee namely Kanak Ram Khandekar does not hold water. It is further important to note that the benefit which was extended to Kanak Ram Khandekar have been withdrawn on 13-12-2021 which is evident from the order dated 13-12-2021. Copy of the order dated 13-12-2021 is annexed herewith as ANNEXURE- D/2.” 3. Accordingly, this writ petition stands disposed off with the aforesaid terms. 4. Learned counsel for the petitioner submits that the petitioner No.6 has died. 5. So far as petitioner No.6 is concerned, who has died, liberty is reserved in favour of the legal representatives of petitioner No.6 to file a fresh petition, if any, if so advised. Sd/- (Sanjay K.
