This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicants who have been arrested in connection with Crime No.435/2025 registered at Police Station Mahasamund, District Mahasamund (C.G.) for the offence punishable under Sections 296, 118(2), 115(2), 191(2), 191(3), GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.01.09 16:08:35 +0530 2 190, 3 (5), 351(3), 324(4) of Bhartiya Nyay Sanhita, 2023. 2. Case of the prosecution, in brief, is that on 04.10.2025, the scuffle occurred between Accused persons and resident of complainant's area and in order to compromise the matter, the Complainant along with Jalandhar Sonwani & Nirmal Singh went near Baronda Chowk wherein the Accused Shubham Chandrakar, Aadi Chandrakar, present Applicant and Someshwar Sahu have assaulted them with stick and rod. Hence the F.I.R. was lodged against them. 3. Learned counsel for the applicant submits that the applicant is said to have assaulted the injured Jalandhar Sonwani with danda and it is stated that though he has received injuries on his head but he was assaulted by one of the co-accused Shubham Chandrakar who is absconding. He would submit that charge sheet has been filed, the applicant is in jail since 6/10/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application. She would submit that the applicant has 7 criminal antecedents, out of which in 5 cases, compromise has been done and 2 cases are pending. She would further submit that the injury which was sustained by the injured Jalandhar Sonwani was on his occipital region and as per the discharge summary, it is evident that he has suffered multiple injuries over the scalp, face, right leg 3 and left forearm, therefore applicant is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, considering the fact that the applicant assaulted the injured Jalandhar Sonwani with danda and the injury which was sustained by the injured Jalandhar Sonwani was on his occipital region and as per the discharge summary, it is evident that he has suffered multiple injuries over the scalp, face, right leg and left forearm, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant Horilal Sahu involved in Crime No.435/2025 registered at Police Station Mahasamund, District Mahasamund (C.G.) for the offence punishable under Sections 296, 118(2), 115(2), 191(2), 191(3), 190, 3 (5), 351(3), 324(4) of Bhartiya Nyay Sanhita, 2023, is rejected. 8.
