I.A. 13066 of 2026 Heard the parties.
Learned counsel for the petitioners submits that this interlocutory application has been filed with the prayer to amend the para 1 and prayer portion of the Bail Application in by correcting the name of the court where Barharwa Rail P.S. case no. 28 of 2026 corresponding to Railway G.R. case no. 41 of 2026 is pending, which has erroneously been mentioned as “learned Railway Judicial Magistrate, Rajmahal” instead of the correct name of the court being “learned Railway Judicial Magistrate 1st Class, Sahibganj” due to inadvertence. It is next submitted that unless the said amendment is allowed, the petitioners will be highly prejudiced. Considering the aforesaid facts, the prayer is allowed and the petitioners are
directed to file consolidated Bail Application incorporating the proposed amendment allowed by this order within two weeks,
failing which, this bail application shall stand dismissed without further reference to the Bench.
Learned counsel for the petitioners file consolidated bail application. Keep the same in the record. This interlocutory application is disposed of accordingly.
(ANIL KUMAR CHOUDHARY, J.) B.A. No. 8443 of 2026 The petitioners have been made accused in connection with Barharwa Rail P.S. case no. 28 of 2026 corresponding to Railway G.R. case no. 41 of 2026 instituted under Sections 303(2), 317(4), 317(5), 3(5) of section of BNS, 2023.
Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners in furtherance of the common intention with the co-accused persons, have committed theft of mobile phone in a habitual manner and 85 mobile phones were recovered from the possession of the petitioner no. 1 and 89 mobile phones were recovered from the possession of the petitioner no. 2. It is submitted that the allegation against the petitioners is false and charge sheet has been submitted against the petitioners. It is further submitted by learned counsel for the petitioners that the petitioners have no criminal antecedent, as mentioned in paragraph 10 of the bail application and except confessional statement, there is no material in the record to implicate the petitioners in this case. It is next submitted that the petitioners have been in jail custody since 12.06.2026, as mentioned in para 1 of this bail application. It is next submitted by learned counsel for the petitioner that the petitioners are ready and willing to co-operate with the trial of the case and undertake not to annoy or disturb the informant or the other witness of the case in any manner
during trial of the case, hence, the petitioners may be admitted to bail. Learned Addl. P.P. opposed the prayer for bail. Considering submissions of learned counsels and the facts as stated above, I am inclined to release the petitioners on bail. Hence, the court below is directed to release the petitioners on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate 1st Class, Sahibganj in connection with Barharwa Rail P.S. case no. 28 of 2026 corresponding to Railway G.R. case no. 41 of 2026 with the condition that the petitioners will not annoy or disturb the informant or the other witness of the case in any manner during trial of the case and will co-operate with the trial of the case and will furnish mobile phone number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change the mobile phone number during the trial of the case.
