Neutral Citation No. (2026:JHHC:29368) IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.(C) No.7565 of 2026 ----- Kalu Oraon, son of Late Hira Oraon, resident of village Khora Chairamba, P.O. Khora, P.S. Gumla, District Gumla, Jharkhand. .......... Petitioner. -Versus- 1. The State of Jharkhand 2. Principal Secretary Land Reforms, having office at Project Building, Dhurwa, Ranchi. 3. The Deputy Commissioner, Gumla. 4. District Land Acquisition Officer, Gumla. .......... Respondents. ----- CORAM : HON’BLE MR. JUSTICE RAJESH SHANKAR ----- For the Petitioner : Mr. Manoj Kr. Choubey, Advocate For the State : Ms. Omiya Anusha, AC to AAG-IA ----- Order No.03 Date: 30.09.2026 1. The grievance of the petitioner as raised in the present writ petition is that though he has been paid compensation for acquisition of the land appertaining to Khata no.143, plot no.3432, village Khora, District Gumla in connection with Land Acquisition Case No.30 of 2023-24, however, no compensation has been paid to him for the structure standing over the said land. 2. Learned counsel for the petitioner refers to the award dated 26th December, 2025 (Annexures-1) prepared with respect to the land computing compensation of Rs.20,37,371/- as well as the award dated 7th February, 2026 (Annexure-2) with respect to the structure made over the said land computing compensation of Rs.16,87,786/-. 3. It is further submitted that the petitioner was paid compensation amount of Rs.20,37,371/- for acquisition of the land, however, the compensation amount of Rs.16,87,786/- as mentioned in the award dated 7th February, 2026 has not yet been paid to him. Neutral Citation No. (2026:JHHC:29368) Aggrieved with the said situation, the petitioner represented the Deputy Commissioner, Gumla- respondent no.3, however, the same was not responded which compelled the petitioner to prefer the present writ petition. 4. Heard learned counsel for the parties and perused the contents of the writ petition. 5. It appears that the District Land Acquisition Officer, Gumla- respondent no.4 prepared two awards with respect to the petitioner’s land and the structure standing over the same. According to the petitioner, he has already been paid the compensation amount for acquisition of the land, however, despite preparation of the award for acquisition of the structure, he has not been paid the compensation amount of Rs.16,87,786/-. The petitioner has also stated that pursuant to the award dated 7th February, 2026, he appeared before the respondent no.4 and submitted all the required documents, however, without assigning any reason, the said amount of compensation has been withheld. 6. Ms. Omiya Anusha, learned AC to AAG-IA appearing on behalf of the respondents submits that the aforesaid claim of the petitioner will be duly considered by the competent authority i.e. the respondent no.4 within a timeframe. 7. Considering the nature of the prayer made in the writ petition, the respondent no.4 is directed to take due steps for payment of compensation for the structure as mentioned in the award dated 7th February, 2026 in connection with Land Acquisition Case Neutral Citation No. (2026:JHHC:29368) No.30 of 2023-24 to the petitioner. If it is found that the petitioner has already submitted the required documents for receiving the said compensation, the respondent no.4 shall complete all exercises within six weeks from the date of receipt/production of a copy of this order. 8. The writ petition is, accordingly, disposed of. 9. The petitioner has also prayed for payment of interest over the awarded amount. This Court is of the view that at this stage the said claim cannot be considered, as sufficient materials are not available on record to suggest that there has been a deliberate delay on the part of the respondent no.4 in not making payment of compensation for acquisition of the structure over the said land.
