Learned counsel for the petitioner submits that the defacto complainant’s husband outraged the modesty of the petitioner’s friend which was protested by the petitioner which led to a scuffle between the petitioner and the defacto complainant’s husband. A complaint was lodged against the defacto complainant’s husband with regard to this incident on 9th June, 2025 following which the present FIR has been lodged. The petitioner is innocent. Learned counsel for the State produces the case diary and opposes the prayer. It appears that the present FIR has followed the earlier FIR lodged by one Puja Mondal, sister of the petitioner’s friend. Injury sustained does not appear to be grievous. Upon consideration of the material available in the Case Diary, this Court is inclined to hold that custodial interrogation of the petitioner is not required for the purpose of investigation. He may be granted anticipatory bail. Accordingly, in the event of arrest, the petitioner namely Gouranga @ Gauranga Gupta be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of 2 like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions laid down under Section 482(2) of the BNSS. The petitioner shall appear before the learned jurisdictional Court and pray for regular bail within two weeks from date. The application for anticipatory bail is disposed of. Case Diary be returned. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
