The Court made the following Order:
The present Writ Petition is filed under Article 226 of the Constitution of India by the petitioner seeking the following relief:
“… to issue a Writ Order of direction particularly one in the nature of Writ of Mandamus to declare the action of the respondents specifically respondent No.3 in frequently summoning petitioners to the respective station and thereby threatening to foist cases against them at the behest of third parties and venturing to interfere in the matrimonial dispute of son of the 1st and 2nd petitioners as illegal, arbitrary and violative of principles of natural justice and consequently to direct the respondents to follow due process of law and pass such order…”
2. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home, appearing for the respondents. 3. The learned Assistant Government Pleader for Home submitted written instructions, stating that the daughter-in-law of petitioner Nos.1 & 2 filed a complaint before the Police, Machavaram Police Station, Palnadu District, alleging harassment for additional dowry. Basing on the said complaint, the Police called petitioner Nos.1 & 2 for a preliminary enquiry. Except that, they have not called the petitioners at any point of time. The Police are not venturing to interfere in the matrimonial dispute of the son of petitioner Nos.1 & 2. Therefore, the allegations made against the Police are false. 4 BM, J W.P.No.14618 of 2026
4. In view of the above instructions, as no crime is registered against petitioner Nos.1 & 2, the Police are directed not to interfere with the life and liberty of petitioner Nos.1 & 2, without following due process of law and no coercive action shall be initiated against petitioner Nos.1 & 2 unless a cognizable offence is made out against them. 5. Accordingly, the Writ Petition is disposed of.
There shall be no order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed. ______________________ BALAJI MEDAMALLI, J
