Adeeti Biswas Mr. Indranuj Dutta, Ms. Benazir Sk …for the petitioner In this application the petitioner/husband has prayed for a direction upon the Court below for expeditious disposal of the Case No.M- 15 of 2022 presently pending before learned Additional Chief Judicial Magistrate, Sealdah. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner/husband submits that the opposite party/wife herein filed an application under Section 125 of the Code of Criminal Procedure on 28.01.2022 along with a prayer for interim maintenance and the Trial Court by an order dated 19.10.2022 was pleased to direct the petitioner to make payment of Rs.40,000/- per month to the opposite party for her maintenance and the maintenance of the minor child. It is alleged that since then the opposite party/wife is taking time one after another and the said proceeding is being dragged by her. Therefore, the petitioner has prayed for a direction upon the Court below for expeditious disposal of the said proceeding. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with. 2 Having heard learned Counsel for the petitioner and that the maintenance application is pending for about four and half years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, CRR 2362 of 2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the proceeding being Case No.M-15 of 2022 and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.
