The petitioners have filed the present writ application praying for a direction upon the respondent nos. 2 to 7 to defreeze the Current Account of the petitioner lying with IndusInd Bank, Savitri Tower Branch, Kolkata. The petitioners submit that the petitioner is maintaining the Current Account with the respondent bank that is the respondent no. 3. The petitioners submits that initially the bank account of the petitioner was freezed by the bank in the month of January, 2025 and thereafter the petitioner has made several request of the authorities but the authorities failed to defreeze the account of the petitioner. 3. Learned counsel for the Bank submits that the account of the petitioner is freezed by the bank on receipt of several complaints from the National Cyber Crime Reporting Portal. 2 4. This Court directed the bank to submit the report; accordingly the bank has filed the report after serving the copy to the learned counsel for the petitioners. Let the same be kept with the record. 5. From the report it is found that altogether there are 11 complaints received by the bank through the National Cyber Crime Reporting Portal of different States. Out of the 11 complaints, two complaints have been fully resolved and at present the total disputed amount is Rs. 72,939/-. 6. In terms of the order passed by this Court, the petitioners have sent the notice to all the investigating agencies on the basis of which the bank has freezed the account of the petitioners. 7. The petitioners have filed the affidavit-of-service showing the notice has been duly served to each authority but none of the authorities are present before this Court in spite of service of notice. The bank has received complaint through the portal against the transaction on the account of the petitioner. Accordingly, the bank has freezed the account of the petitioner. It is not the case of the bank that the bank has received any order from any competent court of law for freezing of the account. It is the specific case of the bank that the bank has freezed the account only on receipt of the report from the National Cyber Crime Reporting portal of different investigating agencies. 8. This Court finds that only the disputed amount is Rs. 72,939/- and due to which the total account of the 3 petitioner has been freezed and the petitioner is not in a position to operate the said bank account. 9. In view of the above, the bank is directed to keep the disputed amount of Rs. 72,939/- in lien and to allow the petitioner to operate the bank account with immediate effect. 10. WPA 9896 of 2026 is disposed of. 11. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities. (Krishna Rao, J.)
