NATARAJ ORAL ORDER The petitioner has sought for a writ in the nature of mandamus to direct respondent No.1 to consider her representation dated 29.12.2025, by which, she requested respondent No.1 not to allot the sites identified towards 40% of the developed land in Sy.Nos.50 and 41 of Challeghatta Village, Kengeri Hobli, Bengaluru, in lieu of cash compensation for the acquisition of the aforesaid lands. 2. (i) The petitioner claims that she is one of the grand daughters of Honnagangappa, who was the owner of the land in Sy.No.50 of Challeghatta Village, which was acquired by respondent No.1 for the purpose of formation of Nadaprabhu Kempegowda layout. She claims that the acquisition was under an incentive scheme, under which 40% of the developed land was to be allotted in lieu of compensation in the form of cash. She contends that as per the aforesaid scheme, her father was allotted 25 sites in his name. An award notice dated - 3 - HC-KAR NC: 2026:KHC:32193 WP No. 3055 of 2026 13.11.2023 along with allotment letters and E-verified measurement letters were issued by the respondent No.1 in respect of those 25 sites. She contends that after the demise of her father, a dispute arose among the family members regarding partition of the said 25 sites, which culminated in filing a suit in O.S.No.2227/2024. In the meanwhile, respondent No.1 issued E-Correct Dimension reports in favour of some third parties who are not connected to petitioner's family and thereby jeopardised the allotment made in favour of her father. The petitioner therefore submitted a representation dated 29.12.2025 to respondent No.1 requesting that no E- Correct Dimension reports be issued in favour of any third party. (ii) The petitioner contends that the said representation is not considered and therefore she apprehends that the properties identified for allotment to her family may become the subject matter of litigation if E-Correct Dimension reports are issued in favour of any third parties. The petitioner therefore seeks a direction to respondent No.1 to consider her representation. - 4 - HC-KAR NC: 2026:KHC:32193 WP No. 3055 of 2026 3. The learned counsel for the petitioner reiterated the above contentions and prays to consider the representation filed by the petitioner. 4. The learned counsel for respondent Nos.1 and 2 submitted that the representation of the petitioner would be considered in accordance with law and appropriate orders would be passed. 5. In view of the above, this petition is allowed. The respondent Nos.1 and 2 are directed to consider the representation of the petitioner and if 25 sites are already allotted to the father of the petitioner, they shall ensure that no E-Correct Dimension reports are issued in favour of any third party. 6.
