PUBLIC PROSECUTOR 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 13065/2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner herein/Accused No.3, seeking regular bail, in Crime No.03 of 2022 of Dumbriguda Police Station, Visakhapatnam, registered for the offences punishable under Sections 20(b)(ii)(C), 25read with 8(C) of the NDPS, Act and Section 111(2)(b) of BNS. 2. Brief facts of the case are that, on 17.01.2022, the petitioner and other accused were found transporting 48 Kgs of ganja. It is the case of the prosecution that the petitioner acted as pilot for the vehicle by which the ganja was being transported and he escaped from the place of seizure. 3. Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondent/State. Perused the material on record. 4. Learned counsel for the petitioner would submit that the petitioner/Accused No.3 was remanded to judicial custody on 01.09.2025 and since then, he has been in judicial custody. 5. Learned Assistant Public Prosecutor submits that the case is still under investigation and some more witnesses are to be examined and the statutory period is not over. The quantity of contraband involved in present crime is 48 Kgs of Ganja, which is a commercial quantity. . 3 6. In view of the aforesaid facts and circumstances of the case, petitioner does not deserve for grant of bail at this stage. Accordingly, the Criminal Petition is dismissed.
