Learned counsel for the petitioner would submit that the order dated 17.03.2026, by which the departmental enquiry has been contemplated against the petitioner and the charge sheet dated 07.04.2026 (Annexure P/1) has been issued to the petitioner on the very same allegations which are subject matter of the pending criminal case and pursuant to which the departmental enquiry has been initiated against the petitioner. In support of his contention, he places reliance upon M. Paul Anthony vs. Bharat Gold Mines Ltd. [(1999) 3 SCC 679], Stanzen Toyotetsu India (P) Ltd. vs. Girish V. and others [(2014) 3 SCC 636. Advocate General for the State along with Shri Luv Sharma, learned Panel Lawyer for the State appears and accepts notice on behalf of State/respondent No. 1 to 4 and is granted three weeks time to file reply. On payment of P.F. within ten days notice be issued to the respondent No. 5. I.A. No. 01/2026 This is an application for grant of interim relief. Issue notice on this application also, as above. Considering the submission made by learned 3 / 3 shoaib counsel for the petitioner that the charges in the departmental enquiry and the criminal proceedings arise out of the same set of facts and are based on identical evidence and also considering the law laid down by the Supreme Court, purely as an interim measure, it is directed that the further proceedings of the departmental enquiry pending against the petitioner shall remain stayed till the next date of hearing.
