WPA 15957 of 2026 (Md. Abu Jahed vs. State of West Bengal & Ors.)
Mr. Sayantan Hazra …. For the Petitioner Mr. D. N. Ray Mr. MadhuJana Ms. Simran Sureka …. For the State
Affidavit of service filed on behalf of the petitioner is taken on record. The petitioner who is the Pradhan of Nawada Jadupur Gram Panchayat has assailed the no confidence motion and the subsequent notice of meeting issued by the Prescribed Authority on the ground that the motion has been signed by one of the members Md. Reajuddin whereas the said member has signed as Md. Riyajuddin in a resolution of the Panchayat on 26th September, 2023. Learned counsel submits that the signature of the said member in the motion is fake. Also, one of the requisitionists Md. Nasimul Haque did not appear before the Prescribed Authority for verification of his signature on the date fixed by the authority. Learned counsel for the State submits that the motion has been floated by more than 1/3rd of the members of the Panchayat and is in accordance with Section 12(2) of the West Bengal Panchayat Act, 1973.
2 I have considered the rival contention of the parties. It is a fact that Md. Reajuddin has spelt his name differently in the motion and in the resolution dated 26th September, 2023. It cannot be ascertained whether one of his signatures is fake or whether he has changed the spelling of his name after the resolution dated 26th September, 2023. The motion has been signed by 18 out of 30 members of the Panchayat. Therefore, even if two of the requisitionists are not considered, the motion is still floated by 1/3rd of the existing members and in accordance with Section 12(2) of the Act. In view of the fact that the motion, the verification and the date of meeting are in conformity with Section 12 of the Act, no interference by this Court is required. The writ petition is devoid of any merit and is accordingly dismissed. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
