(NDPS) 951 of 2026 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Basirhat Police Station Case No. 914 of 2025 dated 25.09.2025 under Sections 132/3(5) of the Bharatiya Nyaya Sanhita, 2023 and Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In Re : Sainoor @ Sahnoor Mondal ... Petitioner. Mr. Ashok Kumar Chowdhury ... For the Petitioner. Mr. Shataroop Purkayastha ... For the State. Learned advocate appearing for the petitioner submits that although the recovery in the present case is 110 bottles of Phensedyl, but there has been no recovery from the present petitioner and petitioner is in custody for eight months; charge-sheet has already been submitted before the jurisdictional court and prosecution has relied upon 11 witnesses in order to prove its case. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account the facts of the case as also the factum that other accused persons are evading the process of law. However, having regard to the period of detention of the present petitioner and quantum of recovery in the present case as also the possibility of the trial consuming some time, I am inclined to release the petitioner 2 on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Sainoor @ Sahnoor Mondal shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 8th Court, Barasat. If on bail, the petitioner shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of North 24- Parganas without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 951 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
