In this application petitioner has prayed for expeditious disposal of the proceeding initiated under Section 138 of the N.I.Act being C.R. Case No.281 of 2022 presently pending before learned Judicial Magistrate, 4th Court, Purba Bardhaman. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the complaint was lodged on 08.04.2022. Till date the cross-examination of the complainant could not be started as the accused person wilfully delayed the said proceeding and taking adjournments one after another. He further submits that under the statute such proceeding under Section 138 of the N.I.Act are to be disposed of within a time frame but the Court below is giving indulgence to the accused persons for taking adjournment and, as such, the Trial is getting delayed for no fault of the complainant. Having heard learned Counsel for the petitioner and that the complaint case is pending for disposal for more than 4 years, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, CRR 5068 of 2025 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious 2 disposal of the proceeding being C.R. Case No.281 of 2022 and to make his best endeavour to conclude the entire proceeding preferably within a period of six months from the next date of hearing.
