1. By filing the present writ petition under Article 226 of the Constitution of India, the petitioner-Institution has sought issuance of an appropriate writ directing respondent No.2 to conduct inspection of the petitioner's institution and thereafter consider and decide its application for grant/continuation of permission to run the GNM (General Nursing and Midwifery) course in accordance with law. The petitioner has prayed for following relief(s) :-
“(1) to direct the Respondent-2 to carry out the inspection of the Petitioner Institution and pass appropriate order for grant of permission to run/continue the course of GNM. (2) any other relief, which the Hon'ble Court considers proper, may kindly be awarded.”

Learned counsel for the petitioner submits that the petitioner- Institution has been imparting nursing education by conducting the GNM course with an approved intake of 40 students. It is submitted that despite the petitioner having removed all alleged deficiencies and repeatedly approaching the respondent authorities by submitting applications along with the requisite inspection fee, the respondents have failed to conduct inspection of the institution and have kept the petitioner's application pending without any justification.

Learned counsel further submits that due to such inaction, the petitioner has already suffered two zero-admission academic sessions, namely 2024-2025 and 2025-2026, causing serious prejudice to the institution. It is, therefore, prayed that the respondent authorities be directed to conduct inspection of the petitioner's institution and thereafter take an appropriate decision on its application within a time-bound period.
4. Learned State counsel, appearing for the respondent-State, and
learned counsel appearing for respondent No.3 submit that the respondent authorities have no objection if a reasonable time is granted by this Court and assure that the inspection of the petitioner's institution shall be carried out within a period of 30 days.
5. I have heard learned counsel for the parties and perused the material available on record.

Considering the facts and circumstances of the case, particularly the limited grievance raised by the petitioner regarding non- conduct of inspection, and in view of the fair stand taken on behalf of the respondent authorities, without expressing any opinion on the merits of the petitioner's claim, respondent Nos.2 and 3 are
directed to conduct inspection of the petitioner's institution, as sought by the petitioner, within a period of 30 days from today. Thereafter, the competent authority shall consider and decide the petitioner's claim for grant/continuation of permission to run the
4 GNM course, strictly in accordance with law, after affording due opportunity of hearing to the petitioner and after following the prescribed statutory procedure.
7. It is made clear that this Court has not expressed any opinion on the merits of the petitioner's entitlement and the competent authority shall take an independent decision on the basis of the inspection report and other relevant material, in accordance with law.
8. With the aforesaid observations and directions, the writ petition stands disposed of.
