These are the first bail applications filed under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants, who have been arrested in connection with Crime No.58/2026, registered at Police Station Champa, District Janjgir-Champa (C.G.) for the offence punishable under Sections 21 (C) & 29 of NDPS Act. 2. The case of the prosecution, is that the Police of police station Champa had received a secrete information from the Informant that on 10.02.2026 two persons travelling to Kosmanda are carrying intoxicating capsules. On search by the team, 10 packest of Pyeevon Spas plus Dicyclomine HCL, Tramadol HCL and Acetaminophen Capsule (Total 2312) and 06 packets 3 Pyeevon Spas SIONE Plus Dicyclomine HCL, Tramadol HCL and Acetaminophen IGH Capsule (Total1440), total 3752 illegal intoxicating capsules were recovered. The total weight of the capsules were 2359.07 gram. Thereafter a case was registered against the accused persons. 3. Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in crime in question. They further submitted that the prosecution has not followed the mandatory compliance of the NDPS Act and a false case has been registered against the applicants. The seizure memo prepared by the police is also false and baseless. They further submitted that the applicants Pradeep Patel and Ramkishore are in jail since 10.02.2026, whereas the applicants Prakash Chauhan and Sushil Vishwakarma are in jail since 12.03.2026 and the charge sheet has not yet been filed. Therefore, the present applicants may be released on regular bail. 4. On the other hand, learned State counsel opposes the bail application of the applicants and submits that the applicants are involved in carrying illegal substances and the same was seized from their joint possession, which is a very serious offence and the investigation is already going on, as such they are not entitled to be released on bail at this stage. 4 5. I have heard learned counsel for the parties and perused all the documents available on record. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of the offence and for the fact that the matter is already under investigation and the charge sheet has not been filed, therefore, without commenting anything on the merits of the case, I am not inclined to allow the instant bail applications. 7.
