Learned counsel for the petitioner is before this Court seeking for the following reliefs:- "a) Quash the communications dated 09.06.2022 issued by the Department of Food and Public - 3 - HC-KAR NC: 2026:KHC:34181 WP No. 13034 of 2026 Distribution bearing No.485831/2022/SO/(SDF) (produced as Annexure-B), the Communication dated 27.07.2022 issued by the Department of Food and Public Distribution bearing No.506566/2022/SO/(SDF) (produced as Annexure-C) rejecting issuance of the No Dues Certificate and the letter dated 18.12.2023 issued by the Chief General Manager, Sugar Development Fund (produced as Annexure-D), insofar as the said communications refuse and/or withhold issuance of the NDC and NOC to the petitioner. b) Issue a writ in the nature of Mandamus directing the respondents to issue the direct the respondents to issue No Due Certificate and NOC to the petitioner as sought for vide representation produced as (Annexure-Z) and representation dated 13.11.2025 (Annexure- AB); c) Pass such other or further orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of this case." 2. Learned counsel for the petitioner has filed a memo seeking permission to withdraw the above writ petition. The memo reads as under:- "MEMO FOR WITHDRAWAL The petitioner submits that the prayer in the present writ petition does not survive for consideration as the respondents have issued the required NOC and NDC and as such the petition has been rendered infructuous. - 4 - HC-KAR NC: 2026:KHC:34181 WP No. 13034 of 2026 Hence this petition may kindly be dismissed as withdrawn. This memo may kindly be taken on record in the interest of justice and equity." 3.
