Case No.828 of 2025 dated 18.05.2025 under Sections 21(c)/25/27A/29 of the NDPS Act, 1985. And In the matter of: Abdulla @ Abdullah Sk. ….Petitioner. Md. Wasim Akram Ms. Sabrina Parveen …for the petitioner. Mr. Somnath Adhikary ….for the State. Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that the petitioner has been falsely implicated in this case. Other than the statement of co-accused, there are no incriminating materials available against the present petitioner. Learned counsel appearing on behalf of the State relies on the case diary and the report and opposes the prayer for anticipatory bail. He submits that although as per the report there is no criminal antecedent or money trail that could implicate the petitioner, there are three criminal antecedents available against the present petitioner including over serious charges, however, not involving the provisions of the NDPS Act. More importantly, as per the earlier report filed, proclamation and attachment had already been executed against the present petitioner and he had been absconding for a very long time. 2 Considering the above, the other incriminating materials available in the case diary, the fact that that the petitioner has remain absconding for a considerable period of time and that proclamation and attachment had to be executed against the present petitioner, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
