The petitioners are in custody for one year seven months. The prosecution has already examined five witnesses and intends to examine 15 witnesses in total. It has also been contended that two of the independent witnesses did not support the prosecution’s case. Learned advocate for the State opposes the prayer for bail as the quantum of contraband which has been seized is of commercial quantity. I have taken into account the factum of the independent witnesses not supporting the prosecution’s 2 case; the petitioners being in custody for one year seven months and the fact that 10 more witnesses are left to be examined by the prosecution. Having considered the overall circumstances including the factum of the time to be required to take the trial to its logical conclusion, I am inclined to release the petitioners on bail. Hence, the prayer for bail of the petitioners is Allowed. Accordingly, the petitioners viz, Alimul Islam and Manoj Kumar shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court under NDPS Act, 5th Court, Berhampore, Murshidabad. If on bail, the petitioners shall also make themselves physically available on each and every date so fixed by the learned Special court/trial court and shall not leave the district of Murshidabad without prior permission of the learned Special court/trial court. Accordingly, CRM (NDPS) 1463 of 2026 is allowed.
