Case No. 4641 of 2024). And In Re : Aliul Sk @ Patan Sk and another ... Petitioners. Mr. Suman De, Mr. Abhinaba Mukherjee ... For the Petitioners. Mr. Gouranga Kumar Das, APP, Mr. Soumya Raha ... For the State. Learned advocate appearing for the petitioners submits that the petitioners are in custody for 217 days and are similarly placed as the other accused person viz. Sultan Sk. @ Jamirul @ Jamirul Sk. who has been granted bail on 10.09.2025 in CRM (M) 1244 of 2025. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail, but is unable to refute the contentions of the petitioners that the present petitioners are not similarly placed as the other accused who has been granted bail in CRM (M) 1244 of 2025. Having regard to the fact that the present petitioners are similarly situated as the other accused viz. Sultan Sk. @ Jamirul @ Jamirul Sk. who has been granted bail on 10.09.2025 in CRM (M) 1244 of 2025, I am of the opinion 2 that the present petitioners viz., 1. Aliul Sk @ Patan Sk and 2. Md. Manikul Islam @ Anikul Sk be released on bail by the learned Trial Court being the learned Additional Chief Judicial Magistrate, Lalbagh, Murshidabad on the same terms and conditions as the other accused who has been granted bail in CRM (M) 1244 of 2025. Accordingly, the prayer for bail of the petitioners is allowed. Mr. Gouranga Kumar Das, learned APP along with Mr. Soumya Raha, learned advocate was directed to appear on behalf of the State. Their appointment may be regularised by the concerned authorities. The application for bail, being CRM (M) 2877 of 2025, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
