Kausik (Allowed) CRM (M) 2869 of 2025 In Re: An application for bail under Section 439 of the Code of Criminal Procedure, 1973/Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Balurghat Police Station Case No. 234/2023 dated 29.03.2023 under Sections 341/302/34 of the Indian Penal Code. Learned advocate appearing for the petitioner submits that petitioner is in custody for 3 years and 3 months and out of 17 witnesses, 8 witnesses till date has been examined. Learned advocate for the State opposes the prayer for bail. I have taken into account the materials appearing in the case diary. The disputes arose in front of a shop when initially the deceased insulted and assaulted the present petitioner. Thereafter this petitioner threw away the victim by holding his throat and also kicked him and assaulted him. There are no deadly weapons involved in the present case. As a result of a free fight, the incident happened and in fact, the deceased succumbed to injuries on a subsequent date. 2 Having considered the overall circumstances and the manner in which the trial is progressing, I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Suraj Rabidas shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned CJM, Balurghat, Dakshin Dinajpur. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Trial Court. Accordingly, CRM (M) 2869 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
