CORAM : THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE CHALLA GUNARANJAN DATE : 7th January 2026 P C :
The petitioner challenges the appointment of respondent No.4 as a Junior Assistant on compassionate grounds by claiming that the certificates on the basis of which the appointment was sought and obtained were forged and fabricated.
2. In our opinion, the Public Interest Litigation is not maintainable. Reference in this regard can be made to the judgments of the Apex Court in Dr. Duryodhan Sahu v. Jitendra Kumar Mishra1 and Gurpal Singh v. State of Punjab2. It would be, however, open to the petitioner to approach the learned single Judge by way of Quo Warranto, if so advised.
