GP FOR SOCIAL WELFARE The Court made the following: ORDER: The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:- “…to issue a writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the highhanded and unauthorized action of respondents more particularly respondent No 1 in proceedings to dispossess the petitioner from his shop and house situated in Sy No. 47 and 231 of Nunepally Village of Nandyal Mandal and District without issuing any notice and opportunity claiming the property belongs to Waqf Property since 1963 as arbitrary illegal and violative of Article 300A of the Constitution of India and consequently direct the respondent No 1 to forbear from taking further action for demolition of shops and houses of the petitioner in Sy No. 47 and 231 of Nunnepally Village of Nandyal Mandal and District without following the due process of law by according opportunity to the petitioner and to pass….” 2. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for respondent No.1. 3. Mr. Vadapalli Ramesh, learned counsel for the petitioner, submits that the respondents, more particularly respondent No.1, are proceeding to dispossess the petitioner from his shop and house situated in Sy.Nos.47 and 231 of Noonepalli Village, Nandyal Mandal and District, without issuing any notice or providing any opportunity of hearing, by claiming that the property is a Waqf property since 1963. 3 Dr. YLR, J W.P.No.14895 of 2026 Dated 28.05.2026 4. Mr. Shaik Kaja Pasha, learned Standing Counsel, submits that the schedule property situated in Sy.Nos.47 and 231 of Noonepalli Village is a notified Waqf property belonging to Sunni Mosque, Noonepalli, and that the petitioner is fully aware of the nature and status of the property. It is further submitted that the apprehension expressed by the petitioner regarding demolition of the shops and houses is misconceived and that the official respondents would act strictly in accordance with law while dealing with the alleged encroachments over the Waqf property. 5. Considering the entire facts and circumstances of the case, and recording the submissions made by the learned Standing Counsel, the writ petition is disposed of directing respondent No.1 not to dispossess the petitioner from his shop and house situated in Sy.Nos.47 and 231 of Noonepalli Village, Nandyal Mandal and District, without following due process of law by issuing notice and affording an opportunity of hearing with regard to the contentions raised by the petitioner. 6. With the above observations and directions, the Writ Petition is disposed of. There shall be no order as to costs.
