Ms. Jyothi Ratna A, learned Junior Standing Counsel representing Sri Venkata Rama Rao Kota, learned Standing Counsel for APSPDCL (Respondent Nos.2 to 4), has submitted the Written Instructions along with certain documents. The same are taken on record. 3. The Written Instruction would indicate that the power supply of the Writ Petitioner was restored in terms of the Interim Order passed by this Court dated 22.03.2017 in W.P.M.P.No.12542 of 2017. Sri T. Sanjeeva Rao, learned Assistant Government Pleader for Revenue, has drawn the attention of this Court to the Counter Affidavit filed by the Tahsildar/Mandal Revenue Officer (Respondent No.5) dated 20.06.2017. Learned Assistant Government Pleader has drawn the attention of this Court to para 3 of the Counter Affidavit. The said para 3 is usefully extracted hereunder: “3. In reply to Para 3 of the affidavit, it is submitted that severe drought situation is prevailing in Ananthapuramu District as well as in Putlur Mandal drinking water problem is arised in Putlur Village. In the 17 Villages in this Mandal the drinking water is transporting and supplying to the public by spending huge amount from the Government. The District Collector, Ananthapuramu during the Video conference on 13-3-2017 has directed to reduce the transportation of drinking water by identifying the water source in and around the Villages. The Gram Panchayat Sarpanch and respectable elders of Putlur Mandal have represented in the Grievance day and requested to seize the un-authorized bore wells in the Putlur Tank which are drilled by the adjacent formers use the water for their fields. Due to un- authorized bore wells the available water and ground water 3 in the Tank are dried-up and hence drinking water problem arised. In view of the District Collector, Ananthapuramu and Public representation the Putlur Tank has been surveyed and identified 29 un-authorized bore wells are drilled in Tank by the adjacent to the tank farmers and they have draw the water and diverted to their fields. They have informed to close their un-authorized bore wells in the interest of the Public to avoid the transportation of drinking water. Accordingly all of them have removed their electric motors from the un-authorized bore wells voluntarily. The said bore wells have been seized by the Mandal Level Team by recording the Panchanama and covering Photograph of the seizer of the programme. The petitioner Sri S.Chandrasekhar Reddy S/o Nagireddy of P.Chinthapalli H/o Putlur Village has encroached in Putlur Tank Bed Land in Sy.1557 and drilled un-authorised borewell within an extent about 0.10 cents and misguide the Electrical Authorities obtained the agriculture service connection as if that he has drilled the borewell in his own patta land in Sy.No.683-B2 and 683-C2 total extent 5.60 acres and un-authorisedly diverting the water from Putlur Tank.” 4. The above extract would clearly indicate that the Writ Petitioner has dug a borewell unauthorizedly, which is against the public interest and that too by way of unauthorized encroachment into the Tank Bed. It transpires from record that the Writ Petitioner has not responded to this contention by filing any Re-joinder. 5. Having regard to these facts, particularly the above extract from the Counter Affidavit of the Mandal Revenue Officer (Respondent No.5), this Court is of the opinion that there is no merit in the present Writ Petition. Accordingly, this Writ Petition is dismissed both on the grounds of non-prosecution as well as on merit. No order as to costs. 6. Interlocutory Applications, if any, stand closed in terms of this order. ______________________________________ GANNAMANENI RAMAKRISHNA PRASAD, J Dt:08.01.2026 Vns
