JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question proceedings in C.C.No.5432/2024, pending before the II Addl. CJM (ACJM), Bengaluru Rural District, Bengaluru, for the offences under Sections 498-A, 323, 504, 506 of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Sri.Ramesha H.N, learned counsel appearing for the petitioner, Sri.B.N.Jagadeesha, learned Addl. SPP appearing for respondent No.1, Sri.Dayananda B.M, learned counsel appearing for respondent No.2 and have perused the material on record. - 3 - HC-KAR NC: 2026:KHC:20163 CRL.P No. 3764 of 2026 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows: “WE, Sri. Chethan N S/o Late Nanjunda, Aged about 32 years, R/at No.38/2, 80 feet Road, Kariyanapalya, BSK 6th Stage, Bengaluru City- 560109 AND: Smt. Anusha T Kidiyuru W/o Chethan, Aged about 31 years, R/at No.38/2, 80 feet Road, Kariyanapalya, BSK 6th Stage, Bengaluru City-560109 do hereby solemnly affirm and state on oath as follows: 1. We state that, we are Petitioner/Accused No.1 and Respondent No.2/Complainant respectively in the above case. We know the facts and circumstances of the case. Hence we are swearing to this joint affidavit. 2. We state that, the averments made in the petition may kindly be read as part and parcel of this affidavit in order to avoid the repetition of facts. 3. We state that, we have filed the above criminal petition to quash the entire charge sheet and entire proceedings in C.C.No.5432/2024 pending before the II Additional Chief Judicial Magistrate (ACJM), Bengaluru Rural District, Bengaluru for the alleged offences punishable under Section 498-A, 323, 504, 506 of Indian Penal Code and Section 3, 4 of the Dowry Prohibition Act 1961 registered by the Thalaghattapura Police in Crime No.119/2024. 4. We state that, the Petitioner/Accused No.1 and the Complainant/Respondent No.2 are living together as husband and wife in the same house. 5. We state that, as per the advice from our elders and well-wishers we are entering in to compromise - 4 - HC-KAR NC: 2026:KHC:20163 CRL.P No. 3764 of 2026 to avoid differences and dispute between us herein to lead a peaceful life without misunderstanding and more particularly to have peace and tranquillity between us. 6. We state that, we declare that, we have resolved all our disputes and differences arose between us and in pursuance of the compromise we herein withdraw the allegations. 7. We state that, we are entering in to the joint affidavit with free will and consent without any force, threat or coercion or undue influence. We state that, the contents in the affidavit are true and correct to the best of our knowledge, information and belief. WHEREFORE, We humbly request before this Hon'ble Court, that this Hon'ble Court may be pleased to quash the entire charge sheet and entire proceedings in C.C. No.5432/2024 pending before the II Additional Chief Judicial Magistrate (ACJM), Bengaluru Rural District, Bengaluru for the alleged offences punishable under Section 498-A, 323, 504, 506 of Indian Penal Code and Section 3, 4 of the Dowry Prohibition Act 1961 registered by the Thalaghattapura Police in Crime No.119/2024 in the ends of justice.” 4. The parties to the lis are present before this Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the - 5 - HC-KAR NC: 2026:KHC:20163 CRL.P No. 3764 of 2026 compounding application and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in C.C.No.5432/2024 pending before the II Addl.
