HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU WP(C) No. 814/2026 CM No. 1837/2026 1. Aman Verma S/O Sunil Kumar R/O Ward No.16, Dhani Dhar, Rajouri. 2. Shilpi Chandan D/O Parvesh Kumar R/O Ward No.1, Harni, Poonch .....Applicant(s)/Petitioner(s) Through :- Mr. Chaitanya Mahajan, Advocate. v/s UT of J&K and Others .....Respondent(s) Through :- Ms. Chetna Manhas, Advocate vice Mrs. Monika Kohli, Sr. AAG for R-1 to 5. None for R-6 to 11. CORAM: HON’BLE MS. JUSTICE MOKSHA KHAJURIA KAZMI, JUDGE ORDER 31.08.2026 1. This court vide its order dated 08.04.2026, while issuing notice to the respondents for filing objections, had directed the official respondents to provide protection to the petitioners herein and posted the matter for listing on 29.04.2026. Thereafter, the matter could not be taken up due to paucity of time and was adjourned several times and is finally listed before this court today. 2. Learned counsel for respondents 6 to 11 have chosen not to appear nor any reply has been filed on their behalf. It seems that they have no objection with the marriage, which has been solemnized between the petitioners. Sr. No. 49 2 3. Perusal of record annexed with writ petition, prima facie, reveals that petitioners are major and have contracted marriage on 18.03.2023, according to Hindu Personal Law, Rites and Customs. 4. In view of the ratio laid down by the Supreme Court in Lata Singh v. State of U.P. (2006) 5 SCC 475, and Shakti Vahini v. Union of India & Ors. AIR 2018 SC 1601, the official respondents are directed to provide adequate protection to the life and liberty of the petitioners, however, this shall not prevent the official respondents to carry out the investigation of a case which may be registered against the petitioners in respect of any other incident. 5. Needless to say, that disposal of instant petition does not authenticate petitioners’ marriage or their age/majority to enter into marriage. 6. Disposed of along with connected CM. (Moksha Khajuria Kazmi) Judge JAMMU 31.08.2026 Raj Kumar Raj Kumar 2026.09.01 11:01 I attest to the accuracy and integrity of this document
