Tirupati District, as being illegal, arbitrary, unjust, violative of Articles 14, 19 (1) (d), 21 and 300A of the Constitution of India and violative of Principles of Natural Justice IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased Counsel for the Petitioner(S): 1. VIVEKANANDA VIRUPAKSHA Counsel for the Respondent(S): 1. V VENKATA NAGA RAJU(CENTRAL GOVT COUNSEL) 2. GP FOR REVENUE THE HON’BLE SRI JUSTICE K SREENIVASA REDDY WRIT PETITION No: 35497 of 2025 ORDER: This Writ Petition has been filed seeking to issue a Writ more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondent Nos.1 to 4 herein in delinking the road connecting the plots belonging to the Petitioners in an extent of about Ac.10.00 cents in Sy.No.151 B of Ramireddy Palli Village, Chandragiri Mandal, Tirupati District from the main road abutting Level Crossing (LC) 92, Railway Gate, Tirupati by constructing an underpass, without arranging alternate road to the petitioners to reach their plots in Sy.No151 B of Ramireddy Palli Village, Chandragiri Mandal. Tirupati District, as being illegal, arbitrary, unjust, violative of Articles 14, 19 (1) (d), 21 and 300A of the Constitution of India and violative of Principles of Natural Justice. 2. Case of the petitioners herein is that Respondent Nos. 1 to 3 constructed an underpass at Railway Point LC92 with walls measuring 20 feet in height on both sides. The said construction has delinked the rasta that connected the petitioners’ plots to the BT road. The plot owners objected to the construction on the ground that it would sever access to their plots from the main road situated on the western side, thereby leaving them without any connection to the main road. 3. Similarly situated plots and agricultural lands are located on the western side of the blacktop road. The rasta leading to those plots, shown as NKOP in the plan, was also delinked due to the construction of the underpass at LC92. However, the railways formed a separate road, KLMN, exclusively for those landowners to enable them to access their respective plots. 4. Aggrieved by the discriminatory treatment, the petitioners have repeatedly approached the respondents to either remove the blockage or provide an alternative passage, as shown in the plan as HIJF, to enable access to their plots. However, to date, the respondents have failed to consider their representations. Hence, the present Writ Petition. 5. Learned counsel for the petitioners submits that several representations have been made to respondent Nos.1 to 3 herein, but no action has been taken by the said respondents. He further submits that representation has been made to respondent Nos.2 and 4 herein on 05.07.2022 on the ground that the respondents have constructed an underpass in LC92. By virtue of the same, a road has been disconnected to the A.D. point for under pass bridge and about 15 feet height wall was constructed by South Central Railways and because of the same, the petitioners have no road facility now. Learned counsel for the petitioners further submits that inspite of several representations, no orders were passed till today. 6. In view of the contents of the representation made by the petitioners herein, this Court is of the opinion that, without going into the merits of the case, it would be appropriate to direct the respondents to dispose of the representations submitted by the petitioners within a period of four (4) weeks from the date of receipt of a copy of this order. 7. It is needless to mention that, as and when the respondents pass orders on the representation made by the petitioners, the same shall be communicated to the petitioners as expeditiously as possible. 8. With the above directions, the Writ Petition is disposed of. No costs. As a sequel, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. ___________________________________ JUSTICE K.
