Apprehending their arrest, the petitioners have moved this Court for grant of privilege of anticipatory bail in connection with Barwadda P.S. The Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners being the members of an unlawful assembly attempted to murder the members of the informant party. It is further submitted that the allegations against the petitioner are all false. It is then submitted that the petitioners are not named in the F.I.R. and the reference of the petitioners have been made in the F.I.R. by referring them to be the ladies of the family of the co-accused persons. It is next submitted that there is no specific allegation against the petitioners. It is then submitted that for the self-same occurrence from the side of the petitioners, Dhananjay Mahato first lodged Barwadda P.S. Case No. 36 of 2026 and as a counter-blast, this false case has been foisted. It is also submitted that the petitioners have no criminal antecedent as has been mentioned in para-26 of the instant anticipatory bail application. It is then submitted that the petitioners undertake to furnish sufficient security including cash security. Considering the submissions of the counsels and the fact as discussed above, I am of the opinion that it is a fit case where the above-named petitioners be given the privilege of anticipatory bail.
