ORAL ORDER
1. Learned Additional Government Advocate accepts notice for respondent Nos.1 to 5.
2. The petitioner is before this Court seeking for the following reliefs:

a. Issue a Writ, Order or Direction/s in the nature of CERTIORARI quashing the impugned notice dated 26.08.2025 bearing No. Sa.Kaa.Aa/Lo.Yi/No.4 Hu.Vi/Magadi/Sa.Im-2/2025-26/333 and the impugned bearing No. notice dated 12.09.2025 Sa.Kaa.Aa/Lo.Yi/No.4 Hu.Vi/Magadi/Sa.Im-2/2025- 26/388 and the impugned notice dated 5.072025 bearing No. Sa.Kaa.Aa/Lo.Yi/No.4 Hu.Vi/Magadi/Sa.Im-2/2026-27/77 issued the by ANNEXURE-A, B and C Respectively. 5th Respondent.
b. Issue any other appropriate Writ,
Order or Direction/s as this Hon'ble Court deems fit under the
facts and circumstances of the case, in the interest of justice and equity.
3. The petitioner claims to be the absolute owner of the land in Survey No.272/52, measuring 3 acres 0.50 guntas situated in Maruru Village, Narasandra Hobli, Magadi Taluk, which he has now tenanted out for the purpose of running a convention hall.
4. The petitioner is now aggrieved by the respondents' claiming that the compound wall constructed by the petitioner is encroaching on a road and apprehends that the said compound wall would be demolished by the respondents.
5. A perusal of Annexure-K, being the letter issued by respondent No.5, indicates that the Tahsildar has been requested to demarcate the property. The notices which have been challenged by the petitioner are show cause notices. The respondent No.5 having

indicated that the property has to be demarcated, it would always be available for the petitioner to reply to the said show cause notices. The respondents would necessarily have to carry out a joint survey in the presence of the petitioner to demarcate the land of the petitioner and the road to verify and ascertain if there is any encroachment made by the petitioner and thereafter take necessary action in accordance with law.
6. With the above observation, the petition stands
disposed.
7. Needless to say, until such joint survey is made, respondents cannot seek to demolish any portion of the compound wall.
