The petitioner-Bahadur Ali S/o Beru, R/o village Mantalai, tehsil Chenani, district Udhampur identifies himself to have brought up in adoption one Mohd. Sharif S/o late Hukum Din, r/o Village Mantalai, tehsil Chenani, district Udhampur who reportedly died under suspicious circumstances on 13.05.2026 within the jurisdiction of the Police Station Jharkhand, Chattisgarh. 2. The petitioner is seeking indulgence of this Court to direct investigation to be concluded by the Central Bureau of Investigation (CBI) with respect to suspicious death of said Mohd. Sharif. 3. Deceased- Mohd. Sharif was brought from Jharkhand to his native place in Mantalai, Udhampur where his dead body came to be subjected to burial by reference to which the petitioner submits that at the time of burial of the deal body of the deceased taking place, several injuries including multiple fractures of leg and Regular Cause List Serial No. 03 2 WP(Crl) No. 85/2026 arms and broken teeth were noticed wherefrom suspicion about foul play attending the death of said Mohd. Sharif is said to have been entertained by the petitioner. If that was the scenario, then the petitioner ought not to have allowed the burial of the dead body of the deceased-Mohd. Sharif without first notifying the Police of the Police Station Chenani, district Udhampur about this aspect attending dead body of the deceased Mohd. Sharif for enabling a requisite police action. 4. Without going into the veracity of the apprehension and assertion of the petitioner, this Court is of the view that given the fact that death of Mohd. Sharif had taken place within the territorial jurisdiction of the Police Station Jharkhand, State of Chattisgarh, as such, if any, indulgence is intended by the petitioner for investigation of the case related to death of Mohd. Sharif, then the same can be expected by the petitioner by soliciting the indulgence of the Hon’ble High Court of Chattisgarh and, therefore, this Court is having no jurisdiction to come forward with the direction of the nature, as solicited by the petitioner, as such, the petition is not entertained and hence dismissed.
