Learned advocate appearing for the petitioner submits that the petitioner is similarly situated as the other accused person who has been granted bail in CRM(NDPS)858 of 2026 Learned advocate appearing for the State opposes the prayer for bail but is unable to refute the contention that the petitioner is not similarly placed as the other accused who has been granted bail. Having considered that the petitioner and the other accused are on similar footing, petitioner be extended the same benefit and the petitioner, namely, Nirmal Kumar Pandey @ Nirmal Kumar Oandey be released by the learned trial court on same terms and conditions as Gaffar who has been released on bail in CRM(NDPS)858 of 2026. Thus, CRM(NDPS) 1416 of 2026 is allowed. 2 Memo of Evidence submitted by the State be kept with the record.
