Let affidavit-of-service, as filed in Court, be kept on record. 2. In spite of service, none appears for the State. 3. Mr. Chatterjee, learned Junior Standing Counsel is present in Court. He is requested to take up this matter on behalf of the authorities. 4. Let his appointment be regularized. 5. The petitioner is a doctor in the West Bengal Health Service Cadre. He had applied for trainee reserve and study leave to pursue his academic career for the purpose of furthering his professional intent. It appears that the petitioner has not yet been granted the trainee reserve, though the study leave was rejected on May 2, 2025 without any reason. 2 6. The petitioner seems to have satisfied all eligibility criteria, as stipulated in the Notification dated June 2, 2015 of the Government of West Bengal, Department of Health and Family Welfare. 7. The petitioner has, thereafter, made a representation on June 1, 2026 which has not been considered as yet. 8. The respondent no. 4 is directed to consider and dispose of the representation of June 1, 2026 in accordance with law, keeping in mind the Notification dated June 2, 2015 as well as the fact that the petitioner will have to pay a sum of Rs.32,00,000/- inclusive of tuition fees, course fees and seats surrender charges. The petitioner has already applied for trainee reserve as well as sponsorship for which No Objection Certificate has been issued in his favour. 9. Let this representation be considered and disposed of by a reasoned order by July 31, 2026. 10. Representation should be considered in the light of and keeping in mind the fact that similarly situated persons as the petitioner, had been granted study leave and trainee reserve enabling them to pursue their career. 11. A seat has already been reserved in favour of the petitioner and is lying vacant in Gouri Devi Institute 3 of Medical Sciences and Hospital, being respondent no. 11 herein. 12. The resultant order should be communicated to the petitioner as well as the respondent no. 11 by August 5, 2026. 13. With the aforestated directions, the writ petition is disposed of. 14. There will be no order as to costs. 15. Urgent photostat certified copy of the order, if applied for, be given to the parties upon usual undertakings. (Reetobroto Kumar Mitra, J.)
