CWP-20211-2026 #1# IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH. 109 CWP-20211-2026 Date of Decision:-08.07.2026 Ankit. ......Petitioner. Vs. Haryana State Pharmacy Council. ......Respondent. CORAM:- HON'BLE MR. JUSTICE KULDEEP TIWARI Present:- Mr. V.B. Godara, Advocate for the Petitioner. *** KULDEEP TIWARI, J. (ORAL) 1. The petitioner, by way of instant writ petition, as cast under Article 226 of the Constitution of India, prays for issuance of a Mandamus upon the respondent to issue him drug licence for opening a Chemist Shop after completion of D. Pharma from a well recognized college i.e. OK College of Pharmacy (Institute ID: PCI-4345) registered under OPJS University, Churu Rajasthan. 2. Learned counsel for the petitioner submits that the petitioner has already approached the respondent authorities, vide his application dated 06.09.2022 (Annexure P-4), as regards his concerned/grievances. However, due to a lackadaisical and indolent approach of the authorities concerned, considerable time has elapsed, but the said application has not been VINAY MAHAJAN 2026.07.09 18:22 I attest to the accuracy and integrity of this document CWP-20211-2026 #2# processed/decided so far. 3. Notice of motion. 4. Mr. Gopal Sharma, Advocate, accepts notice on behalf of the respondent-Haryana State Pharmacy Council. At the outset, he fairly submits that he has no objection, in case, a Mandamus is passed upon the respondent, to take final decision upon the application (Annexure P-4). 5. In view of the above, and since a bona fide and innocuous prayer has been made on behalf of the petitioner, the instant writ petition is disposed of, by issuing a Mandamus upon the respondent, to consider and decide the application, by passing a speaking order, within a period of eight weeks from the receipt of certified copy of this order. Needless to assert that before drawing a final order, a due opportunity of hearing shall be afforded to the petitioner. 6. However, in the event of default in compliance of the hereinabove direction, the petitioner is at liberty to move an apt application/motion for revival of the instant petition.
