THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R. NATARAJ ORAL ORDER The petitioners have sought for a writ in the nature of mandamus to directing the respondent to consider their application bearing No.J¯ïJPÀÆå ¸ÀASÉå:(3)¹.Dgï.41/1992/93 dated 17.01.2017 under Section 28-A(1) of the Land Acquisition Act, 1894 (henceforth referred to as ‘the Act, 1894’) and pass an award and re-determine the compensation payable in respect - 4 - HC-KAR NC: 2026:KHC:32119 WP No. 15692 of 2025 of their land in survey No.8/2 of Devanooru Village, Mysore Taluk, measuring 2 acres 23 guntas including kharab. 2. (i) The petitioners contend that they are the legal representatives of the owners of the aforesaid land, which was notified for acquisition for the purposes of Mysore Urban Development Authority. The respondent passed an award determining the compensation payable to the predecessors of the petitioners. The compensation awarded was received under protest. The petitioners contend that similarly situated land was also acquired and an award was passed. (ii) Later, the owner of that land sought reference under Section 18 of the Act, 1894 in L.A.C. No.229/2008. The III Additional Senior Civil Judge and CJM, Mysuru in terms of the judgment and award dated 19.10.2016 enhanced the compensation from Rs.57,500/- per acre to Rs.15,73,000/- per acre. The petitioners soon after coming to know of the enhanced compensation awarded by the reference Court filed an application on 17.01.2017 seeking the benefit of Section 28- A of the Act, 1894. - 5 - HC-KAR NC: 2026:KHC:32119 WP No. 15692 of 2025 (iii) The petitioners claim that though the application is filed in the year 2017, no steps are taken by the respondent to enhance the compensation and therefore the petitioners are before this Court seeking for direction to the respondent to consider the request and pass an award redetermining the compensation payable to them as per the judgment and award dated 19.10.2016 passed by the III Additional Senior Civil Judge and CJM, Mysuru in L.A.C. No.229/2008. 3. The learned counsel for the petitioner reiterated the above submissions and submitted that the subject matter of L.A.C. No.229/2008 was the land bearing Sy.No.8/1 of Devanooru Village. He therefore submits that the petitioners are also entitled for the benefit of enhanced compensation. 4. The learned counsel for the respondent submitted that if the petitioners are entitled to the benefit of Section 28-A of the Act, 1894, in the light of the judgment and award passed in L.A.C. No.229/2008, the same would be considered in accordance with law and appropriate orders would be passed. 5. The respondent is directed to consider the application of the petitioners for enhanced compensation in view of the judgment and award passed by the III Additional Senior Civil Judge and CJM, Mysuru, dated 19.10.2016 in L.A.C. No.229/2008, as provided under Section 28-A of the Land Acquisition Act, 1894. This shall be complied within a period of three months from the date of receipt of a certified copy of this order.
