For the Respondent no. 6 The petitioner claims to be the owner of the plot in question and submits that since the private respondents were disturbing his possession therein, she filed a civil suit which was dismissed. The petitioner preferred an appeal against the said dismissal. The appeal was allowed and decree granted in her favour. The private respondents preferred second appeal against the said decree which was dismissed. The petitioner alleges that since the private respondents have raised temporary polythene structure by encroaching upon the northern side of the land, she is unable to put up the fence therein for demarcation of the same. Upon consideration of the submission made on behalf of the parties, this Court is of the view that since the allegation of the petitioner in the writ petition is encroachment of a portion of her land by the private 2 respondents, the dispute between the parties is a private and civil dispute which needs to be dealt with by the appropriate civil Court. The petitioner is at liberty to approach the said Court for redressal of her grievance. The writ petition is devoid of any merit and is accordingly dismissed. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
