In Re: An application for Bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Baishnabnagar Police Station Case No.146 of 2025 dated 12.02.2025 under Sections 179/180/61(2) of the Bharatiya Nyaya Sanhita, 2023 of the Indian Penal Code;
Manish Kumar @ Manish Poddar Kumar @ Manish Kumar Poddar Versus The State of West Bengal
Mr. Tapodip Gupta Ms. Usashi Chattopadhyay Mr. Golam Ahammed. …for the petitioner.
Mr. Sagar Saha. …for the State.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 4 months and submits that the petitioner is similarly situated as another accused, namely, Pintu Kumar.
I find that the order was obtained by suppressing the facts before the learned sessions judge, as such, the issue relating to parity is not considered by this Court.
The subject matter of the case as pointed out by the learned advocate appearing for the State relates to recovery of 297 FICNs. Initially, recovery was from the present petitioner which subsequently led to further recovery.
Having considered the stage of the case that only charge-
2 sheet has been submitted and till date charges have not been framed, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected at this stage.
Thus, CRM(M)2821 of 2025 is dismissed at this stage.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
