Mr. Gouranga Kumar Das and Ms. Nayana Mukhopadhyay, learned advocates, appear on behalf of the State. Their appearance may be regularized by the concerned authorities. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 2 months and similarly placed accused person has already been granted bail in CRM(M)310 of 2026. Learned advocate for the State opposes the prayer for bail. Attention of the Court has been drawn to the statement of the witnesses under Section 183 of the BNSS. I have taken into account the materials appearing against the present petitioner and on an assessment of the same, I am of the opinion that the petitioner is similarly placed as the other 2 accused, namely, Motilal Das @ Matilal Das who has been granted bail in CRM(M)310 of 2026. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Rishi Das @ Hrishikesh Das be released by the learned trial court on same terms and conditions as was imposed to Motilal Das @ Matilal Das in CRM(M)310 of 2026. Thus, CRM(M) 2761 of 2025 is allowed. Memo of Evidence submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
