JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for all the respondents. 2. The prayer in the writ petition is to issue a writ of mandamus directing the respondent authorities to conduct phodi and durast of 2 acres of land in Sy.No.57 of Sulthanpete Village, Nandi Hobli, Chikkaballapura Taluk and District. However, during the course of these proceedings, the attention of this Court is drawn to Annexure-L, orders passed by this Court in W.P.No.3005/2022 in respect of the same property in - 3 - HC-KAR NC: 2026:KHC:19504 WP No. 33553 of 2025 question seeking the very same relief of phodi and durast. However, learned counsel for the petitioner submitted that the said writ petition was filed by Smt.Narasamma and not by the petitioner herein. It is contended that from the year 2014, the land in question belongs to the petitioner in terms of the compromise petition entered into before the competent Civil Court. 3. Nevertheless, this Court finds that when the directions issued by this Court in W.P.No.3005/2022 was not complied with by the respondent authorities, the petitioner therein filed a contempt petition in CCC No.1042/2023. The State and its authorities also filed Writ Appeal No.980/2024, and both the matters were considered by the Division Bench and orders have been passed in terms of Annexure-A dated 08.04.2025. This Court finds that the Division Bench has issued directions to the competent authorities to implement the order of the learned Single Judge within six weeks upon making of the representation by the original petitioner. 4. In that view of the matter, this Court is of the considered opinion that, a fresh writ petition need not be filed - 4 - HC-KAR NC: 2026:KHC:19504 WP No. 33553 of 2025 by the petitioner seeking directions to implement the orders passed by the Division Bench. Even if the petitioner is not a party to the proceedings before the Division Bench, it will be open for the petitioner to file necessary application bringing to the notice of the Hon'ble Division Bench the fact that the petitioner is admittedly the owner of the property in question and the phodi and durast was sought in respect of the same property as was directed by the Hon'ble Division Bench, but the respondents have failed to comply with the directions. 5. With these observations, while leave granted to the petitioner to file an application before the Hon'ble Division Bench, the writ petition stands disposed of.
