09/07/2026 D/L – 49 Court No.28 S. Kundu Rejected C.R.M.(A) 1297 of 2026 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Raninagar P.S case no. 22 of 2026 dated 07/01/2026 under sections 351(2)//3(5) of the BNS read with Section 12 of the POCSO Act and Section 8 of the POCSO Act. In the matter of: Dipankar Sing @ Dipankar Mondal & Anr. ...Petitioners. Mr. Tapodip Gupta …for the petitioners. Mr. Gurudas Mitra Mr. Utsav Dutta …for the State. 1. Report filed on behalf of the State is taken on record. 2. Despite service, no one appears on behalf of the de-facto complainant. 3. Learned counsel appearing on behalf of the petitioners submits that the petitioners have been falsely implicated in this case. The main accused was arrested and was thereafter granted bail. Charge sheet has been submitted. 4. Learned counsel appearing on behalf of the State relies on the statement of victim recorded before the learned Magistrate and statements of immediate post-occurrence witnesses. He also refers to the other materials available in the case diary. 5. Considering the above, the serious nature of the allegations and the incriminating materials available in 2 the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioners. 6. Accordingly, the application for anticipatory bail is rejected. 7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
