Kausik (Rejected) CRM (M) 2815 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with English Bazar Women Police Station Case No. 253/2022 dated 12.12.2022 under Section 506 of the Indian Penal Code, 1860 read with Sections 4/17 of the POCSO Act, 2012. And In the matter of : Ram Mandal ……Petitioner. Mr. Avinaba Patra ….for the Petitioner. Mr. Rajendra Banerjee, Ld. APP Mr. Bhaskar Seth …for the State. Learned advocate appearing for the petitioner submits petitioner is in custody for 3 years 7 months and till date only 4 witnesses have been examined out of the 27 witnesses cited by the prosecution. Emphasis has been made on the evidence of the victim. On the other hand, learned advocate for the State submits that 8 witnesses have been examined and prosecution would put in efforts to conclude the trial at the earliest. I have taken into account the statement of the victim under Section 183 of the BNSS. So far as the complicity of the present petitioner is concerned, it has been categorically contended regarding the present petitioner having violated the 2 privacy of the victim. There were other accused persons who aided the present accused. Having considered the age of the victim, the manner in which the offence has been committed and the complicity of the present petitioner, I am of the opinion, petitioner’s participation in the offence is clearly distinguishable from the other accused persons. Having considered the same, I am not inclined to release the petitioner on bail. As such, prayer for bail of the petitioner in CRM (M) 2815 of 2025 is dismissed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
