JUSTICE E.S.INDIRESH - 3 - HC-KAR NC: 2026:KHC:34410 WP No. 17760 of 2024 ORAL ORDER In this writ petition, the petitioner is assailing the communication dated 15.04.2023 (Annexure-J), endorsement dated 15.02.2024 (Annexure-L) issued by respondents No.5 and 1 respectively, inter alia sought for direction to respondent No.3 to consider the representation dated 03.10.2019 and representation dated 07.02.2024 (Annexures-C and K respectively). 2. Having heard the learned counsel appearing for the parties and on careful examination of the writ papers and the submission made by respondent No.6 would indicate that the claim made by the petitioner for durasth in respect of the land in question is based on the agreement of sale produced at Annexure-B to the writ petition. 3. In that view of the matter, taking into consideration that, as the agreement of sale cannot confer any title in respect of the land in question in favour of the - 4 - HC-KAR NC: 2026:KHC:34410 WP No. 17760 of 2024 petitioner, in view of the judgment of this Court in W.P.No.201156/2025, I am of the view that the petitioner being an agreement holder has no right to seek phodi in respect of the land in question which is belonging to respondent No.6. 4.
