Sri Subhajit Nag -versus- Smt. Chandrima Nag
Mr. S.P. Dalapati Mr. A. Santra Mr. Indraneel Ganguly ..for the petitioner
This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 8th Court at Alipore, South 24 Parganas to dispose of the Miscellaneous Case No. 180 of 2020 expeditiously. The learned advocate appearing for the petitioner submits that Misc. Case No. 180 of 2020 arises out of an application under Section 36 of the Special Marriage Act. He submits that though the miscellaneous case is fixed for further cross-examination of the P.W.-1, but the wife/opposite party herein is not appearing in the miscellaneous case and is taking adjournment thereby causing delay in the disposal of the matrimonial suit. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith.
2 In the light of the submissions made by the learned advocate for the petitioner, C.O. 2092 of 2026 stands disposed of by requesting the learned Additional District Judge, 8th Court at Alipore, South 24 Parganas to take up the Miscellaneous Case No. 180 of 2020 for further cross- examination of P.W.1 on the next date fixed and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
