Heard Mr. Santosh Kumar, learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner is an accused in connection with Katras (East Basuria) P.S. Case No. 279 of 2025.
A dacoity was committed in the house of the informant and valuables were looted.
Submission has been advanced by the learned counsel for the petitioner that the petitioner has been implicated on the confession of co-accused. It has been submitted that no Test Identification Parade has been held and the petitioner is in custody since 12.09.2025. Learned counsel submits that some jewelries were recovered from the house of the petitioner on account of the fact that the petitioner used to purchase jewelry and it is an admitted fact that the petitioner did not participate in the dacoity. Learned counsel for the petitioner submits that the petitioner has a criminal antecedent in which he had already been granted bail.
Learned A.P.P. has opposed the prayer for bail of the petitioner.
It appears that the petitioner is a goldsmith who had purchased the jewelry and it seems that he had no direct participation in the dacoity so committed.
Considering the aforesaid facts, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Dhanbad in connection with Katras (East Basuria) P.S. Case No. 279 of 2025.
