Accused nos.1 to 3 in Crime No.56/2026 registered by Nanjanagudu Police Station, Mysuru District, for the offences punishable under Sections 108 read with 3(5) of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. - 3 - HC-KAR NC: 2026:KHC:34908 CRL.P No. 9233 of 2026 2. Heard the learned Counsel for the petitioners and the learned HCGP on behalf of the respondent-State. 3. FIR was registered in the present case by Nanjangudu Police Station, Mysuru District, in Crime No.56/2026 for the aforesaid offences against the petitioners herein based on the first information dated 10.06.2026 received from Pushpavathi who is the wife of deceased in the present case. Apprehending arrest in the said case, petitioners had filed Crl. Misc. No.915/2026 before the jurisdictional Sessions Court at Mysuru, which was rejected on 22.06.2026. Therefore, they are before this Court. 4. Perusal of the first information and the material made available to this court would go to show that the petitioners are the employees of Nestle India Limited Company and it appears that deceased Kumaraswamy was working in their factory. On 10.06.2026, Kumaraswamy had committed suicide leaving behind a death note stating that accused persons are the cause for his death. Neither in the first information nor in the death note, there is any mention about the specific act committed by - 4 - HC-KAR NC: 2026:KHC:34908 CRL.P No. 9233 of 2026 the accused persons which would have either abetted or instigated the deceased to commit suicide. Therefore, necessary ingredients to attract the alleged offence is prima facie not present. Petitioners have undertaken to co-operate with the police for the purpose of investigation. Under the circumstances, I am of the opinion that petitioners' prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.56/2026 registered by Nanjanagudu Police Station, Mysuru District, for the offences punishable under Sections 108 read with 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioners shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- each with two sureties for the likesum to the satisfaction of the investigating officer. - 5 - HC-KAR NC: 2026:KHC:34908 CRL.P No. 9233 of 2026 2. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witness and they shall co-operate with the police for investigation and appear before them whenever called upon. 4.
