08.07.2026 Court No.35.
D/L. 301. Kausik (Rejected)
CRM (NDPS) 1386 of 2026
In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Chapra Police Station Case No. 1446 of 2025 dated 12.05.2026 under Section 20(b)(ii)(c)/29 of the NDPS Act, 1985.
And In the matter of : Provas @ Probhas @ Provash Biswas & Ors.
……Petitioners.
Mr. Soumya Nag
Mr. Purbayan Chakraborty
Mrs. Khadijatul Kubra
Mr. Sourav Gupta
……for the Petitioners.
Mr. L. Vishal Kumar
……for the State.
Learned advocate appearing for the petitioners submits that petitioners were arrested on November, 2025 and since then they are in custody for about 9 months. Charge sheet has already been submitted before the jurisdictional Court. However, till date charges have not been framed and the prosecution has relied upon 13 witnesses in order to prove its case.
Learned advocate for the State opposes the prayer for bail.
Having considered the quantum of seizure in the present case, I am of the opinion that rigors of Section 37 of the
2 NDPS Act is attracted. As such, prayer for bail of the petitioners is rejected.
Petitioners would renew their prayer for bail after the evidence of the seizure list witnesses are over.
Learned Special Court is directed to prioritize the evidence of the seizure list witnesses and within 3 months from the date of consideration of charges, the same be completed.
Accordingly, CRM (NDPS) 1386 of 2026 is dismissed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
