Rasool …..for the appellant. Mr. Sumit Ray ….for the WBSEDCL. 1. The appellant prays for supply of new electric connection, at the same premises in which there are outstanding dues. The appellant admits that there is a nexus between the earlier consumer and the new applicant. The appellant’s case is that, there are no dues and all unpaid dues have been cleared. 2. The WBSEDCL filed an affidavit before the writ court, indicating non-payment of dues. 3. The dispute now is factual. While the appellant submits that there are no dues, the WBSEDCL had relied upon documents and bills to show that there were outstanding dues. Thus, His Lordship has rightly treated the dispute to be a billing dispute and granted liberty to the appellant to follow the regulations and to 2 approach the Grievance Redressal Officer. The writ court cannot enter into disputed questions of fact between the parties and adjudicate the same, by the bills. 4. Under such circumstances, the order impugned dated January 27, 2026, passed in WPA 26945 of 2024, does not call for any interference. 5. Accordingly, the appeal and the connected application are dismissed. 6. Parties are directed to act on the basis of the server copy of this order. (Shampa Sarkar, J.) (Smita Das De, J.)
