1. K V N RANGANAYAKAMMA Counsel for the Respondent/complainant(S):
1. PUBLIC PROSECUTOR The Court made the following:
THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 31/2026 ORDER :
The instant petition under Section 482 of the Code of Criminal Procedure, 1973 has been filed, by the Petitioner/Accused, seeking quashment of the proceedings against him C.C.No.52 of 2025 on the file of the First Additional Junior Civil Judge, Tenali, arising out of Crime No.161 of 2024 of Tenali, III Town Police Station registered under Section for offences 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Ms.K.V.N.Ranganayakamma, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, Learned Assistant Public Prosecutor representing on behalf of the State. 3. Considering the submissions made and on a careful perusal of the material placed on record, it is evident that the petitioner is Accused No. 1 and the husband of the de-facto complainant. The allegations in the charge sheet disclose specific accusations against Accused No. 1 which, prima facie, attract the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. 4. In that view, this Court is of the opinion that this is not a fit case for exercise of inherent powers to quash the proceedings. Accordingly, the Court is inclined to dispose of the matter at the stage of admission itself. 5. Accordingly, the criminal petition is disposed of without causing any prejudice to the rights and contentions of the petitioner. The petitioner is at liberty to raise all contentions before the trial Court in his defence. As a sequel thereto, the miscellaneous petitions, if any pending, shall stand closed.
