Case No.357 of 2025 dated 04.11.2025 under Sections 137(2)/140(3)/3(5) of the BNS, 2023. And In the matter of: Manoranjan Pramanik and another … petitioners Mr. Navanil De Mr. Subhrajit Dey … for the petitioners Mr. Krishendu Bhattacharya Mr. Pritam Roy … for the State Learned counsel for the petitioners submits that the present petitioners are the parents of the principal accused. The alleged victim, after attaining majority, married the principal accused. The victim is in the family way. As such, she could not approach the investigating agency. A direction was passed by this Court to have the statement of the victim recorded after some time. No one appears on behalf of the alleged victim although the victim was represented and had supported the contention of the petitioners on 18.05.2026. Learned counsel for the State relies on the case diary and opposes the prayer for anticipatory bail. He files a report which contains the subsequent statement of the victim recorded before the learned Magistrate on 02.06.2026. In 2 the said statement, the alleged victim claimed that she had voluntarily fled away to her maternal uncle’s house as her parents were forcing her to get married even before attaining the age of majority. Considering the above, the other materials available in the case diary and the fact that the principal accused is not before this Court, I am inclined to grant anticipatory bail to the petitioners. In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioners shall shall cooperate with the investigation, shall not threaten or intimidate witnesses and the petitioner No.1 shall meet the investigating officer once a fortnight till submission of report in final form. The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
